On June 29th, a headline named “President has signed an amnesty for nine categories of prisoners" spread in a flash and has attracted wide public attention immediately. Below, follow me to understand the amnesty system more clearly。

Since the release of the amnesty, there have been some viewpoints that "prisons must be cleared" and "detention centers must be emptied" on the Internet, but please pay attention,the opportunity for amnesty is not universal or formed by luck , only the criminals who meet one of the following nine criteria are eligible for the amnesty:

The first are those who ever participated in the Chinese People’s Anti-Japanese War and the Chinese People’s Liberation War;

The second are those who ever participated in foreign warfare to safeguard state sovereignty, security and territorial integrity, after the founding of the People's Republic of China.

The third are those who ever made great contributions to the construction of important national projects as well as obtained such above provincial and ministerial-level honorary titles as "model worker", "advanced worker"and "Labor Day Medal" ;

The forth are those who were the active duty soldiers and ever gained individual award of first-class merit or above;

The fifth are those who were sentenced to imprisonment for unjustifiable self-defense or excessive risk aversion， which were under three years or remaining less than one year.

The sixth are those who are over 75 years old, seriously disabled and unable to take care of themselves;

The seventh are those who were under 18 at the time of the crime and sentenced to imprisonment which were under three years or remaining less than one year.

The eighth are those windowed females who need to raise their children that are minor or seriously disabled and unable to look after themselves, which the aforementioned females were sentenced to imprisonment which were under three years or remaining less than one year.

The ninth are those who have served more than one-fifth of the probation period for parole, or have been sentenced to punishment of control.

In 2018, Jinyuan district court issued a case about a 16- year- old girl named Xiaoyan, who was a vocational high school student. After hearing of a kind of hard drug effective to lose weight, she began to try it because of her excessive attention to her appearance, which made her fall into a drug quagmire and couldn’t extricate herself from it. Since then, she was repeatedly forced by the public security  organs to detoxify and failed every time, and she invited two classmates to take drugs in her rented house together instead. Finally, Xiaoyan was sentenced to prison for one year and fined 500 yuan for allowing others to take drugs. This amnesty is really a great news for Xiaoyan and her family, because she belongs to the seventh category of the special amnesty. Before long, after the court issues the "release" ruling, Xiaoyan can go home to enjoy her summer holiday  happily .

Many people may ask, why do we have this amnesty?

The year 2019 is not only the 70th anniversary of the foundation of the People’s Republic of China, but also a crucial year when the ‘two centenary goals’ enter a period of historical convergence. Pardoning some criminals specially at this important moment, can not only set up the prestige of the party central committee and the judicial office, but also show the party's confidence and mind. It is helpful to manifest the core chairmanship of the CCP which inherit the Chinese traditional civilization that ‘using teaching by crime’ and ‘discreetly punish with sympathy’. At the same time, the amnesty embodies the concept of "respecting and protecting human rights" in the constitution, it is  conducive to form a good social atmosphere of exercising the state power and governing the country by constitution.  Thus, special amnesty is indeed a popular policy!

People who are unsatisfactory for amnesty don’t need to be discouraged, our country always implements the policy of “tempering justice with mercy”.  In addition to special amnesty, commutation and parole are institutions of encouraging the criminals to rehabilitate. If you know someone who was sentenced to public surveillance, criminal detention, fixed-term imprisonment or life imprisonment, please warn him to obey the regulations of the supervisor  conscientiously, receive education and reform, repent  seriously and strive for the meritorious service  during the execution period. In this way, he can get a bigger chance to commute his sentence. Those who were sentenced to set term of imprisonment and have implemented more than half of the original prison term, or those who were sentenced to life imprisonment and have implemented more than 13 years, if they could obey the prison regulations conscientiously, receive education and reform, actually repent and have no risk of crime, also can be paroled.

In the end ,there is one point we need to pay attention to, the amnesty system only exempts the criminals from punishment but not their guilt , which means even if the criminals are released, they will still be kept on a lifelong record.
