The first question: Which party shall be responsible for the damage and loss of the insured parcel?

The relationship between the consumer and the courier services company that is a contract of transportation in which a courier services company shall bear the damage and loss from the carrying en route.  According to the first provision of Article 832 of the Civil Code, the amount of compensation for damage to or loss of goods shall be agreed upon by the parties. Article 27 of the Interim Regulations on Express Delivery stipulates that if a express delivery is delayed, lost, damaged or has short contents, the liability for compensation for the insured express delivery shall be determined in accordance with the insurance rules agreed between the express delivery business enterprise and the sender. Liability for compensation shall be determined in accordance with the relevant provisions of civil law for uninsured express parcels. So long as there is insurance, it should be paid by the carrier according to the quoted amount.

The second question: Is not the insurance compensation as much as the insured amount?

In fact, there is a law which is provided for the insured amount issue, such as hereinafter. Article 47 of the Postal Law of the People's Republic of China points out that "postal enterprises shall compensate for the loss of vouchered mail in accordance with the following provisions: (1) Where insured vouchered mail is lost or completely damaged, compensation shall be made according to the insured amount; In case of partial damage or short contents, the actual loss of the mail shall be compensated according to the proportion of the insurance amount to the total value of the mail. (2) In case of loss, damage or lack of contents of uninsured documents, compensation shall be made according to the actual loss, but the maximum amount of compensation shall not exceed three times the rate charged; If a registered letter is lost or damaged, compensation shall be made at three times the rate charged."

Therefore, if the quoted delivery is damaged, it can be paid according to the insured amount.

The third question: How to claim compensation?



1. You must retain the evidences, the receipt of the goods and the delivery service receipt firstly, as well as to communicate the courier services companies or the seller to deal with the compensation when the package have been lost and damaged.

2. Base on the materials aforesaid you can make a complain to the referred e-shop platform or to the relevant executive authorities, for example if you bought somethings on Taobao having the argument about the insured amount, you can apply for the Black Cat, and to the website of the State Post Bureau.

3. Besides above the mentioned you can file to the court.

Although, the most courier services companies will remind consumers to insure valuables in the express or the delivery terms, and make relevant provisions on compensation methods and dispute resolution which couldnt become a "shield" to exempt themselves from responsibility, nor could it deprive consumers of the right to claim compensation.
